To be eligible for our services, you must:

  • Provide accurate and complete information during the consultation process

3.2 Enrollment Process

Upon enrollment, you will be required to sign a service agreement that outlines the specific terms of our engagement, including fees, services to be provided, and expected timeline. The enrollment is subject to our assessment of your financial situation and eligibility.

4. Program Details and Client Obligations

4.1 How Our Program Works

Our debt settlement program involves negotiating with your creditors to reduce the total amount owed. The process typically includes:

5. Important Disclosures and Risks

5.1 No Guarantee of Results

IMPORTANT: We cannot guarantee specific results, settlement amounts, or timelines. The decision to settle any debt rests solely with your creditors. While we will negotiate on your behalf with professional expertise, creditors are not obligated to accept settlement offers. Settlement outcomes depend on various factors including creditor policies, your financial circumstances, and market conditions.

5.2 Credit Score Impact

CRITICAL DISCLOSURE: Enrolling in our debt settlement program will have an adverse impact on your credit score. Missed or late payments, settled accounts, and reduced credit limits will be reported to credit bureaus and will negatively affect your creditworthiness. This may impact your ability to obtain new credit, loans, employment, or housing in the future.

5.3 Continued Interest and Fees

During the program, your enrolled accounts will continue to accrue interest, late fees, and penalties unless your creditor agrees to freeze these charges. Your outstanding balance may increase during the negotiation period.

5.4 Collection Activities

While enrolled in our program, you may be subject to aggressive collection activities including frequent phone calls, letters, legal notices, and potential lawsuits from creditors. We cannot guarantee that creditors will cease collection activities. We provide anti-harassment services in accordance with RBI guidelines, but creditors retain legal rights to pursue collection.

5.5 Tax Implications

Forgiven debt may be considered taxable income by the Income Tax Department of India. You are responsible for consulting with a tax professional to understand the tax implications of debt settlement. We do not provide tax advice.

6. Fees and Payment Terms

6.1 Service Fees

Our service fees are clearly disclosed in your enrollment agreement. Fees are typically structured as:

  • Monthly platform or service fees to maintain your account and negotiate with creditors
  • Settlement fees calculated as a percentage of the debt enrolled or debt eliminated

Fee Structure Transparency: We charge fees only for services rendered. Monthly fees may be adjusted against final settlement fees. We do not charge upfront fees before providing services in compliance with industry best practices.

6.2 Payment of Settlements

All settlement payments to creditors are made directly from your designated savings account. You maintain full control and ownership of this account at all times. We do not hold, manage, or have access to your settlement funds.

7. Regulatory Compliance

ClearPaths Finance operates in compliance with Reserve Bank of India (RBI) guidelines for fair practices in lending and debt recovery. We ensure that all negotiations are conducted ethically and legally.

7.2 Anti-Harassment Protection

We provide anti-harassment services to protect you from unethical recovery practices. This includes filing complaints with appropriate authorities, issuing cease and desist notices, and representing your rights under applicable laws. However, creditors retain legitimate collection rights within legal boundaries.

8. Termination and Cancellation

8.1 Your Right to Cancel

You have the right to terminate your enrollment in our program at any time by providing written notice. Upon termination:

  • You will be responsible for any fees accrued up to the termination date
  • We will cease negotiations on your behalf
  • You will retain full access to your savings account
  • Any settlements already negotiated will need to be honored

8.2 Our Right to Terminate

We reserve the right to terminate our services if you fail to comply with the program requirements, provide false information, fail to make required deposits, or engage in conduct that interferes with the settlement process.

9. Limitations of Liability and Disclaimers

9.3 Limitation of Damages
